Terms of Service

1. Agreement

By registering or using Eu Postez (“the Platform”), operated by DIGITAL SPECTRUM S.R.L. (“we”, “us”, “our”), you agree to these Terms. If you do not agree, do not use the Platform. If you are using the Platform on behalf of a business, you confirm you have authority to bind that business.

2. The Platform

Eu Postez is a software-as-a-service platform that enables users to:

  • Create and manage social media content using LaraAI, our AI assistant
  • Connect social media accounts via OAuth authorisation
  • Preview, edit, approve, and publish content to connected platforms
  • Manage brand voice, publishing schedules, and content preferences
  • Receive LaraAI-generated content suggestions based on your brand profile and weekly feedback

The Platform is provided on an “as is” basis. Features may change and we do not guarantee any specific feature will remain permanently available.

3. Accounts

3.1 You must be at least 18 years old to register.

3.2 You must provide accurate, current information and keep it updated.

3.3 You are responsible for all activity under your account, including by team members you invite.

3.4 Keep your credentials secure. Notify us immediately at hello@eupostez.md if you suspect unauthorised access.

3.5 We may refuse registration or terminate accounts at our discretion.

4. Connected Social Media Accounts

4.1 By connecting a social media account, you authorise us to publish content to that account on your behalf using the permissions granted during OAuth.

4.2 You are solely responsible for: the content published to your accounts; compliance with each platform’s Terms of Service (Meta, TikTok, LinkedIn); and any violations, suspensions, or bans imposed by those platforms.

4.3 We are not liable for any action taken by a social media platform against your account.

4.4 You may disconnect any account at any time from the Accounts page. This immediately deletes the stored access token and ends our ability to publish.

4.5 Social media platforms may expire tokens without notice. If a token expires, publishing will fail until you reconnect.

5. Acceptable Use

You agree not to use the Platform to:

  • Post spam, unsolicited messages, or deliberately misleading content
  • Engage in coordinated inauthentic behaviour (fake accounts, fake engagement, astroturfing)
  • Impersonate any individual, brand, or organisation
  • Publish defamatory, harassing, hateful, obscene, or unlawful content
  • Violate any third party’s intellectual property rights
  • Reverse-engineer or attempt to access parts of the Platform you are not authorised to use
  • Scrape or harvest data from social media platforms through the Platform
  • Violate the Terms of Service of any connected social media platform
  • Violate applicable law in your jurisdiction or ours

Violations may result in immediate account suspension without notice or refund.

6. LaraAI-Generated Content

6.1 Captions, hashtags, and other content generated by LaraAI are suggestions only. They are produced automatically and may not always be accurate, appropriate, or compliant with all platform policies.

6.2 You must review all LaraAI-generated content before publishing. The Platform provides a mandatory approval step for this purpose.

6.3 You are solely responsible for all content you publish, whether written by you or generated by LaraAI.

6.4 We do not use your content, brand data, or posts to train AI models.

7. Intellectual Property

7.1 You retain full ownership of all content you create or upload through the Platform. By using the Platform, you grant DIGITAL SPECTRUM S.R.L. a limited, non-exclusive, royalty-free licence to store, process, and transmit your content solely as necessary to provide the service.

7.2 The Platform, including its design, code, features, and all associated intellectual property, is owned exclusively by DIGITAL SPECTRUM S.R.L. You may not copy, modify, or create derivative works from any part of it.

7.3 If you provide feedback or suggestions, we may use them without obligation to you.

8. Payments and Subscriptions

8.1 Access requires a paid subscription. Pricing is shown on our website and within the Platform.

8.2 Subscriptions are billed in advance on a monthly or annual cycle. Payments are processed by Stripe, Inc.

8.3 You may cancel at any time from account settings. Access continues until the end of the current billing period.

8.4 Subscription fees are non-refundable except where required by applicable law. We may issue refunds at our discretion for documented technical failures on our part.

8.5 We will give at least 30 days’ notice of price increases. Continued use after that date constitutes acceptance.

8.6 If a payment fails, we will notify you and retry. If unresolved within 7 days, your account may be suspended until payment is made.

9. Availability and Support

9.1 We aim for reliable service but do not guarantee uninterrupted availability.

9.2 We are not liable for losses from Platform downtime, third-party API outages (Meta, TikTok, LinkedIn, Anthropic), or events outside our reasonable control.

9.3 Support is available at hello@eupostez.md. We aim to respond within 2 business days.

10. Termination

10.1 You may close your account at any time from Settings. Your data will be deleted per our Privacy Policy.

10.2 We may suspend or terminate your account immediately if you breach these Terms, if required by law, or if your use puts us or other users at risk.

10.3 On termination for breach, no refund is owed for any unused subscription period.

11. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS OR OPERATE WITHOUT ERROR OR INTERRUPTION.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL SPECTRUM S.R.L. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, SOCIAL MEDIA ACCOUNT SUSPENSION, OR COST OF SUBSTITUTE SERVICES.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless DIGITAL SPECTRUM S.R.L., its officers, employees, and agents from any claims, damages, costs, and expenses (including legal fees) arising from: your use of the Platform; content you publish; your breach of these Terms; or your violation of any third party’s rights.

14. Governing Law

These Terms are governed by the laws of the Republic of Moldova. Disputes shall first be resolved through good-faith negotiation. If unresolved within 30 days, they are subject to the competent courts of Chisinau, Republic of Moldova. EU consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.

15. General

  • Severability — if any provision is unenforceable, the rest remain in effect.
  • Entire agreement — these Terms and the Privacy Policy form the complete agreement between you and DIGITAL SPECTRUM S.R.L.
  • Waiver — failure to enforce any right is not a waiver of that right.
  • Changes — we will give 14 days’ notice of material changes. Continued use constitutes acceptance.
